  1. COPYRIGHT
    No artwork on this site (inclusive of original paintings, ceramic, sculpture, jewellery, prints & cards) may be reproduced or used in any form by any party/persons, or by any way electronically or mechanically, without express permission from the copyright holders*. This includes downloading, printing, photocopying, or shared via online storage system.

    • All rights reserved for artworks exhibited by the individual artists and Art Matakana Gallery.

    • Artists have the moral right to be identified as the original creator of a work, and to object to false attribution and/or derogatory treatment of their work.

    • All rights reserved for all images (other than artworks) and text used on the Art Matakana Gallery website.

    • Any party/persons seeking to use Artist’s or and /or images from the Art Matakana Gallery website must seek permission by contacting us first.

    • Any image used, once permission has been gained, must be accompanied with reference to the original artist, with Art Matakana Gallery cited as source. The integrity of the image must be maintained, and reproduced in full with no edits or cropping unless agreed upon by the copyright holders.

    *The sale of an artwork/art piece does not transfer or assign any copyright/intellectual property right. You are purchasing the Work, but not the right to produce copies of the Work (including photographs/digital print) for publication/sale or any other acts violating copyright.

  2. REPRESENTATION OF ARTWORKS 

    Whilst every effort is made to accurately portray all works shown on the website, Art Matakana Gallery gives no guarantee that artwork will be identical to it’s photographic representation including, but not limited to, differences arising from:

    • Colour differences due to colour settings/quality of your computer/viewing device.

    • Other conditions existing beyond the control of Art Matakana Gallery that distort the online representation of an artwork.

  3. AVAILABILITY
    Works are marked as SOLD on our website once the sale of the work is confirmed. However, we cannot guarantee the availability of any particular item, and reserve the right to change the availability of an item at any time.

  4. RETURNS & REFUNDS
    We do not offer returns/refunds on an item if you have changed your mind. Once an item is SOLD and has left the building it is not refundable. The buyer also accepts full responsibility for the work, and Art Matakana Gallery ceases to be liable. If you are unsure about a work, enquire with us as to weather you can view the piece in situ.

  5. LAYBY

The gallery offers a Layby service to help you acquire that loved artwork, but don’t have the full funds to purchase right away. Artwork considered sold, with an unrefundable deposit. Please enquire for further details.

10. ARTIST ARTWORK

All artworks represented by the Gallery, whether on our website or held in stock and displayed in the gallery, cannot be sold from the Artist's Website to a customer without acknowledging the gallery right to the share of commission.
